1. Acceptance of these terms
These Terms of Service and Website Use govern your access to and use of the ACTion Psychology website at https://www.actionpsych.com/, including its pages, information, resources, contact forms, and links.
In these Terms, “ACTion Psychology,” “we,” “us,” and “our” refer to ACTion Psychology Group, operating as ACTion Psychology.
By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.
These Terms apply to the public website. They do not replace the informed-consent documents, service agreements, fee and cancellation policies, privacy notices, or other clinical documents that apply when you receive services from a clinician.
2. About ACTion Psychology
ACTion Psychology provides information about psychotherapy, psychology, assessment, consultation, and related mental-health services.
Services may be available in person in Toronto and virtually to eligible clients in Ontario, subject to clinician availability, professional requirements, suitability, informed consent, and any geographic restrictions that apply to a particular clinician or service.
Nothing on the website guarantees that a particular service, clinician, appointment time, fee, or treatment approach will be available.
3. This website is not a crisis service
The website, contact forms, email, voicemail, and online booking functions are not emergency services and are not monitored continuously.
Do not use the website to seek urgent assistance or report an emergency.
If you or another person is in immediate danger, call 911 or go to the nearest emergency department. In Canada, you may call or text 9-8-8 for suicide-crisis support.
ACTion Psychology is not responsible for delays resulting from the use of a non-emergency communication channel during an urgent or crisis situation.
4. Website information is general information
The website provides general educational and service information. It is not intended to provide:
- A diagnosis.
- Individualized psychological or psychotherapeutic advice.
- A treatment recommendation.
- A clinical assessment.
- Medical advice.
- Legal, insurance, financial, or tax advice.
- A substitute for an examination or consultation with a qualified professional.
Mental-health information must be considered in the context of each person’s circumstances. Do not rely solely on website content when making decisions about your health, safety, treatment, medication, insurance, legal rights, or finances.
5. No therapeutic relationship is created through website use
Using the website, reading its content, submitting an inquiry, sending an email, leaving a voicemail, or requesting an appointment does not by itself create a therapist-client, psychologist-client, healthcare-provider, fiduciary, or other professional relationship.
A clinical relationship begins only when:
- An appropriate clinician has agreed to provide services;
- Eligibility, availability, and suitability have been considered;
- Required informed-consent and administrative steps have been completed; and
- The relationship has otherwise been established in accordance with the clinician’s professional obligations.
An initial consultation may be used to discuss fit, needs, scope, and next steps. It does not guarantee acceptance as a client or the availability of ongoing services.
6. Clinical documents take priority
If you become a client, your services will be governed by documents and policies that may address:
- Informed consent.
- Confidentiality and its legal limits.
- Electronic and virtual care.
- Fees, payment, and receipts.
- Cancellation and missed appointments.
- Clinical communication.
- Record keeping and privacy.
- Emergencies and after-hours support.
- Supervision or student involvement.
- Couples, family, minor-client, or third-party services.
- Assessments, reports, insurers, WSIB, or disability claims.
If these Website Terms conflict with a specific clinical agreement, the clinical agreement will govern the clinical service to the extent permitted by law.
7. Appointment and consultation requests
Submitting a booking or consultation request does not guarantee an appointment.
An appointment is confirmed only when you receive confirmation through the applicable booking platform, clinician, or administrative team.
We may decline, cancel, or reschedule an appointment where reasonably necessary, including because of:
- Clinician availability.
- Service suitability.
- Licensing or geographic restrictions.
- Incomplete intake or consent requirements.
- Safety or scope-of-practice concerns.
- Technical or administrative errors.
- Circumstances outside our reasonable control.
You are responsible for reviewing appointment details and promptly notifying us of an error.
8. Jane and other third-party platforms
The website may link to Jane or another external booking, payment, virtual-care, mapping, regulatory, insurer, or resource platform.
When you follow an external link, you leave the ACTion Psychology website. Your use of the third-party platform is governed by that provider’s terms, privacy policy, and security practices.
ACTion Psychology does not control the availability, content, accessibility, security, or independent data practices of a third-party service. A link does not constitute a guarantee or endorsement of every statement, product, or practice of the third party.
We may receive information you submit through an authorized third-party platform where it is required to respond to your request or provide services.
9. Contact forms and electronic communications
You agree to provide accurate contact information when submitting an inquiry or appointment request.
Do not use a contact form or regular email to send:
- Emergency or crisis communications.
- Threats or reports requiring an immediate response.
- Credit-card numbers or banking credentials.
- Government identification numbers unless specifically requested.
- More personal health information than is reasonably necessary for the inquiry.
- Information about another person when you do not have authority to provide it.
- Unlawful, defamatory, abusive, deceptive, or malicious content.
- Malware, harmful code, or automated spam.
Electronic communications carry privacy and security risks. Although we take reasonable precautions, ordinary email, voicemail, text messages, and website transmissions cannot be guaranteed to be completely secure or error-free.
We are not responsible for harm caused by inaccurate contact information, a full mailbox, blocked messages, shared devices, compromised accounts, or your failure to review a response.
10. Acting for another person
You may contact us on behalf of a child, family member, partner, client, employee, or other person only where you are authorized to do so.
By providing information about another person, you represent that:
- The information is accurate to the best of your knowledge.
- You are authorized to provide it or the disclosure is otherwise permitted by law.
- You will not misrepresent your identity, authority, or relationship to that person.
We may require proof of identity, consent, guardianship, substitute decision-making authority, or other legal authority before discussing or releasing information.
11. Fees, payment, insurance, and third-party funding
Website information about fees, reduced rates, insurance, WSIB, disability benefits, or tax treatment is general and may change.
The fee and payment terms confirmed by the clinician or practice at the time of booking or in a service agreement will govern.
Unless expressly agreed otherwise:
- You are responsible for charges associated with services provided to you.
- Payment may be required at or before the appointment.
- You are responsible for understanding your insurance or benefit coverage.
- Coverage and reimbursement are determined by the insurer or benefit administrator, not ACTion Psychology.
- A receipt does not guarantee reimbursement.
- ACTion Psychology does not guarantee that a service will qualify for a tax deduction, credit, insurance payment, WSIB benefit, or disability benefit.
- Cancellation and missed-appointment charges may apply under the policy provided to you.
Contact the insurer, plan administrator, WSIB representative, accountant, lawyer, or tax professional responsible for the relevant decision where confirmation is required.
12. Professional credentials and clinician information
We make reasonable efforts to present accurate clinician biographies, credentials, registration status, areas of focus, fees, and availability.
Credentials, regulatory categories, supervision arrangements, and availability may change. You may verify a clinician’s current registration status through the applicable professional regulator.
Website descriptions of experience or areas of focus are informational and do not guarantee a particular outcome or establish that a clinician is appropriate for every person or concern.
13. Acceptable use
You may use the website only for lawful, personal, and informational purposes.
You must not:
- Attempt to gain unauthorized access to the website, server, forms, accounts, or connected systems.
- Probe, scan, or test a vulnerability without written authorization.
- Interfere with the website’s operation or security.
- Introduce malware, malicious code, or harmful content.
- Use bots, scraping tools, or automated systems in a way that burdens the website or copies protected content.
- Circumvent access controls, rate limits, or security measures.
- Impersonate another person or misrepresent an affiliation.
- Submit fraudulent, misleading, abusive, discriminatory, or unlawful content.
- Harvest contact information.
- Use website content to train, populate, or operate a commercial database or artificial-intelligence system without authorization.
- Reproduce or commercialize website content except as expressly permitted.
- Use the website in a manner that violates another person’s privacy, confidentiality, intellectual-property, or other rights.
We may restrict or block access where we reasonably believe these Terms have been violated or the website, practice, clinicians, clients, or other users may be at risk.
14. Intellectual property
Unless otherwise stated, the website and its original content—including text, branding, graphics, design, layout, downloadable resources, photographs, videos, and other materials—are owned by or licensed to ACTion Psychology and are protected by applicable intellectual-property laws.
You may view and print a reasonable number of pages for your own personal, non-commercial use.
You may not, without prior written permission:
- Republish substantial website content.
- Modify or create derivative commercial works from the content.
- Remove copyright, trademark, attribution, or proprietary notices.
- Sell, license, distribute, or commercially exploit website content.
- Use ACTion Psychology’s name, logo, branding, or clinician likenesses in a manner that suggests endorsement or affiliation.
- Frame or mirror the website on another server.
- Copy content into a competing service or commercial directory.
Brief quotations for lawful commentary, research, or other fair-dealing purposes must include appropriate attribution.
Third-party names, marks, and content remain the property of their respective owners.

Your use of the website is also governed by the ACTion Psychology Privacy Policy and Statement of Information Practices.
The Privacy Policy explains how we handle website, inquiry, administrative, and clinical information, as well as how to contact our Privacy Officer.
By submitting information, you acknowledge that electronic transmission involves some risk and authorize us to use the information to respond to the request, subject to applicable privacy law.
16. Website availability and changes
We may update, suspend, withdraw, restrict, or discontinue any part of the website without notice.
We do not guarantee that:
- The website will always be available.
- The website will be free from delays, interruptions, defects, or harmful components.
- Every page will be compatible with every browser or device.
- Information will always be complete, current, or error-free.
- A message or form submission will be delivered successfully.
- An external link will remain active or accurate.
We may correct errors and update information at any time.
17. No guarantee of outcomes
Psychotherapy, psychological services, and assessments involve individual circumstances and cannot guarantee a specific result.
Website testimonials, descriptions, examples, modalities, educational content, or statements about potential benefits do not constitute a promise that any individual will experience the same result.
The appropriateness and likely benefits and risks of a clinical service should be discussed with the treating professional.
18. Disclaimers
To the maximum extent permitted by law, the website and its public content are provided on an “as is” and “as available” basis.
ACTion Psychology disclaims warranties concerning the website’s availability, merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, security, and freedom from harmful code, except where a warranty cannot legally be excluded.
Nothing in these Terms excludes or limits:
- Rights that cannot legally be waived.
- Obligations under applicable privacy or healthcare legislation.
- A regulated professional’s duties under applicable law and professional standards.
- Liability that cannot legally be excluded.
- The terms of a separate clinical agreement.
19. Limitation of liability for website use
To the maximum extent permitted by law, ACTion Psychology and its directors, employees, contractors, clinicians, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising solely from use of or inability to use the public website.
This may include loss resulting from:
- Reliance on general website information.
- Website downtime or technical errors.
- A delayed, failed, or misdirected inquiry.
- Malware or unauthorized third-party activity despite reasonable safeguards.
- Content or conduct of an external website.
- Your use of an insecure device, network, account, or communication method.
- Information you provide without authority.
This website limitation does not govern professional liability arising from clinical services. Clinical services are governed by applicable law, professional obligations, and the relevant service documents.
Where liability for a website-related matter cannot legally be excluded, it will be limited only to the extent permitted by law.
20. Responsibility for misuse
You are responsible for reasonably foreseeable losses, claims, or expenses caused by your unlawful use of the website, intentional violation of these Terms, infringement of another person’s rights, introduction of malicious code, or fraudulent submission.
This provision does not require you to compensate ACTion Psychology for losses caused by our own negligence, breach of law, or professional misconduct.
21. Changes to these Terms
We may update these Terms to reflect changes in the website, services, technology, law, or business practices.
The current version will be posted on the website with its effective date. Your continued use of the website after an update means that the updated Terms will apply to future website use.
Changes to clinical services will be addressed through the applicable service documents and consent processes rather than solely through an update to these Website Terms.
22. Governing law
These Terms and your use of the website are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules.
Subject to any rights that cannot legally be restricted, disputes concerning the public website will be brought before the courts located in Toronto, Ontario.
23. Severability and waiver
If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect. The affected provision will be interpreted or limited as closely as legally possible to its intended purpose.
A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.
24. Entire agreement for public website use
These Terms and the Privacy Policy constitute the agreement concerning use of the public website.
They do not replace clinical informed consent, service agreements, privacy directives, payment policies, or other documents governing services provided to a client.
